Our Response Process

Upon receipt of a valid and complete DMCA takedown notice, SkyGoFly LLC will:

1. Review the notice for completeness and validity
2. Remove or disable access to the allegedly infringing material promptly, where appropriate
3. Notify the user who posted the material that it has been removed or disabled
4. Document the notice for our records

We reserve the right to determine in our sole discretion whether a notice is valid and complete before taking action.

Counter-Notice Procedure

If you believe that material you posted on the Site was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice. To be valid, your counter-notice must include the following:

1. Identification of the removed material — A description of the material that was removed and the URL(s) where it appeared before removal.
2. Statement under penalty of perjury — A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
3. Submit your counter-notice to the same contact information listed above. Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we may restore the removed material at our discretion.

Repeat Infringer Policy

SkyGoFly LLC maintains a strict repeat infringer policy. In accordance with the DMCA and applicable law, we will terminate the accounts or access privileges of users who are found to be repeat infringers of copyright in appropriate circumstances. We track all valid DMCA notices received and use this information to identify and act against repeat infringers.

A Note on Original Reporting and Third-Party Images

SkyGoFly LLC publishes original aviation news content. However, we recognize that photographs and images used in editorial content may be subject to copyright held by airlines, airports, photographers, wire services, or other third parties. We make reasonable efforts to use properly licensed, credited, or publicly available imagery. Misrepresentation Warning

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys’ fees.
