U.S. prosecutors have recommended pursuing criminal charges against Boeing, marking a significant development in the ongoing legal scrutiny the aerospace giant faces. This recommendation arises from an alleged breach of a 2021 settlement related to two fatal crashes involving its 737 MAX jet, according to sources familiar with the situation.

In 2021, Boeing reached a deferred prosecution agreement with the Justice Department, avoiding a criminal charge of conspiracy to commit fraud linked to the tragedies in 2018 and 2019. This agreement required Boeing to revamp its compliance practices and regularly report its progress in exchange for deferred prosecution. Additionally, Boeing consented to a \$2.5 billion settlement to resolve the probes.

However, recent evaluations by officials in May concluded that Boeing failed to adhere to this agreement, a contention that Boeing disputes. “Boeing has told the Justice Department it disagrees with its determination that the company violated the settlement,” Reuters reported. Despite their disagreement, the aerospace company has maintained that it has “honoured the terms” of the agreement, which was set to expire just days after an incident involving an Alaska Airlines jet on January 5.

The Justice Department has yet to comment on the potential charges and maintains that discussions with Boeing are ongoing, with no final decision made. The exact nature of the potential charges remains undisclosed, but they may extend beyond the initial fraud conspiracy charge.
